1. Agreement

These Terms govern your use of the PHAME rider app. By registering as a rider you accept them. If you do not accept them, do not use the app.

2. You are an independent contractor

PHAME provides a technology platform that introduces you to passengers. You are not an employee, agent or partner of PHAME. You decide when to go online, which requests to accept, and how to run your own tricycle business. You are responsible for your own taxes, licences and any contributions required by law.

3. Eligibility and documents

You must be at least 18, hold a valid driver's licence for the class of tricycle you operate, and provide a valid Ghana Card, roadworthy certificate, insurance and vehicle registration where your town requires them. Your documents must remain valid while you use the app; expired or false documents lead to suspension or removal.

4. Fares and the service fee

Passengers pay the trip fare directly to you. For each completed trip, PHAME charges a service fee that is deducted from your in-app wallet. The fee for your town is shown in the app and may be changed with notice.

5. Wallet balance rules

Your wallet may go negative as service fees accumulate. When your balance reaches the negative limit configured for your town, you are automatically taken offline and cannot receive new requests until you deposit enough to clear the balance. Deposits are non-refundable — see the Deposit & Refund Policy.

6. Conduct, safety and the law

You must obey Ghana's Road Traffic Act, 2004 (Act 683) and its Regulations, carry no more passengers or load than your tricycle is permitted to carry, and never operate while unfit, intoxicated or using a phone in your hand while moving. Harassment, discrimination, threats, and any form of violence towards passengers or other riders are grounds for permanent removal and may be reported to the Police.

7. Deliveries

For Phame Send you must refuse cash, weapons, drugs, live animals and hazardous or illegal goods. You are responsible for the items you accept until they are handed over at the drop-off point.

8. Location and trip data

While you are online, the app records your location so passengers can be matched with you and trips can be tracked. This data is used for dispatch, fares, safety and dispute resolution as described in the Privacy Policy.

9. Suspension and termination

PHAME may suspend or close your account for unsafe driving, fraud, fare manipulation, repeated cancellations, invalid documents, serious passenger complaints, or breach of these Terms. You may stop using the app at any time; unsettled service fees remain payable.

10. Liability

PHAME is not the transport provider and is not liable for accidents, injuries, loss or damage arising from how you operate your tricycle. You are responsible for holding the insurance the law requires. To the maximum extent permitted by law, PHAME's liability to you for any claim is limited to the service fees you paid in the 30 days before the claim.

11. Changes and governing law

We may update these Terms as the service evolves; continued use after an update means you accept them. These Terms are governed by the laws of the Republic of Ghana, and the courts of Ghana have jurisdiction.

12. Contact

Use Support in the app for questions or complaints.
